1. Who we are
CrestVPS B.V. operates virtual server infrastructure across the locations listed on this site. We hold our own IPv4 and IPv6 allocations under AS204871 and are a member of RIPE NCC. Our registered address and company number are on the imprint page.
2. Your account
An account requires a working email address and a password of at least twelve characters. You are responsible for keeping both secure and for everything that happens under your account. Because we hold no other identifier for you, losing access to your email address means losing access to your account, and there is no override we can apply.
3. What you are buying
A virtual machine with the resources listed on your invoice, in the location you selected, for the billing period you paid for. Resources are reserved rather than pooled, except for fair-share CPU on the plans that state it explicitly. We do not overcommit memory on any plan.
4. Payment
All services are prepaid in cryptocurrency through our payment processor. Invoices are issued seven days before renewal. Services are suspended three days after expiry and destroyed seven days after suspension. Overpayments are credited to your balance. Crypto settlement is one-way; refunds are issued as account credit under the refund policy.
5. Acceptable use
The acceptable use policy forms part of these terms. In short: do not host material that is illegal in the jurisdiction where the hardware sits, do not attack other networks from ours, and do not send unsolicited bulk email. Violations are grounds for suspension, and the categories listed in the policy as immediate are grounds for termination without refund.
6. Availability
We commit to the availability figures in the service level agreement and credit your balance automatically when we miss them. Scheduled maintenance is announced at least seventy-two hours in advance and is excluded from availability calculations, as are faults caused by your own configuration.
7. Your data
Your data is yours. We access it only when you ask us to, when a fault requires it and you have consented, or when compelled by valid legal process. We take no ownership of anything you store and claim no licence over it. On termination we destroy the volume and its backups within thirty days.
8. Termination
You may cancel any service at any time from the dashboard, effective at the end of the paid period. We may terminate for violations of the acceptable use policy, for non-payment after the suspension window, or for repeated abuse of support staff. Where a termination is our decision and not caused by a policy violation, we credit unused time.
9. Liability
Our liability is limited to the amount you paid for the affected service in the twelve months before the incident. We are not liable for lost profits, lost data where you had no backup, or consequential damage. Nothing here limits liability for gross negligence or wilful misconduct, which cannot be limited by contract in the jurisdictions we operate in.
10. Changes
We may change these terms with thirty days notice by email. If a change materially disadvantages you, you may cancel within that window and receive credit for unused time. Price changes never apply to a billing period you have already paid for.
11. Law and jurisdiction
These terms are governed by Dutch law. Disputes go to the courts of Amsterdam, without prejudice to mandatory consumer protections in your country of residence.
